Evelyn’s Park Conservancy 2018 Vendor Agreement for ”Market In The Park”

MISSION
Evelyn’s Park Conservancy is a 501(C)(3) organization founded in 2011. The mission of Evelyn’s Park, which opened in April 2017, is to connect people to our city, to our surroundings, and to each other. We inspire generations to enrich their every day.  Every dollar that we receive goes directly back into Evelyn's Park to pay for continuous free programs and maintenance of this wonderful facility.

Evelyn’s Park “Market in the Park” is only one of the permanent, ongoing events here.  It will continue evolving in size, quality and diversity but will always be comprised of vendors with locally-made, sustainable merchandise.  

VENDOR FEES
Effective January, 2018, each vendor at Evelyn’s Park will be required to pay a monthly fee for “Market in the Park” which will be held the third (3rd) Saturday of every month from 9AM to 2PM.  The fee options are outlined below.  Evelyn’s Park reserves the right to make fee adjustments as needed.

Monthly fee plan: $50/month
Quarterly fee plan (3 months): $120/month
Annual fee plan: $480/year

Built into the quarterly fee plan and the annual fee plan is flexibility.  If you know ahead of time that you cannot participate in a given month, we will allow you to forward the fees for that month to the first month of the following quarter.  There is no additional cost for this and you do not forfeit any money.  

We ask that you provide advance notification (at least 3 days prior) if you cannot participate so that we have time to secure a substitute vendor.  

If timely notice is not provided for an absence at the Market, fees paid will be lost and will not be reimbursed.  

VENDOR PAYMENTS
Payment must be made at least 24 hours prior to the Market.  Payments can be made via the Evelyn’s Park website at https://www.evelynspark.org/forms/vendor-payment

Participating non-profit organizations will not incur vendor fees.

PERMITS
Evelyn’s Park Conservancy requires a copy of your City of Houston permits.  Permits are required of food vendors only. These are to be emailed to us at events@evelynspark.org, or uploaded with your application.

WEATHER OR EMERGENCY
Evelyn’s Park “Market in the Park” will operate year round, come rain or shine.  Vendors should be prepared for all kinds of weather.  Should an unforeseen weather or emergency event prevent our safety or security, Evelyn’s Park will cancel the Market.  

VENDOR’S PHYSICAL SPACE
Evelyn’s Park will make every effort to accommodate vendor’s requests for the physical space needed to sell merchandise.  Unfortunately, we cannot “hold” a space for your tent/stall/table.  Market space is filled on a first come/first served basis.  Vendors are encouraged to arrive early to have the most flexibility.  You can change your space from market to market. 

MARKET OPERATIONS
Date and Time - Evelyn’s Park “Market in the Park” will take place the third (3rd) Saturday of each month from 9AM to 2PM.
Arrival and Load-In - Vendor load-in will begin at 8:00AM via the Bellaire Boulevard driveway (next to the Evelyn’s Park sign). You will be directed where to position your vehicle for unloading and where to set up.
Unloading is to be completed no later than 8:45AM and all vendor vehicles must then be moved to the Bellaire United Methodist Church Scout House parking lot (southwest corner of Bellaire and Newcastle - 4511 Bellaire Blvd.).  This is a free parking area across the street.
All vendor booths need to be set up and completely ready by the 9:00AM event start time.
Equipment - Vendors are responsible for supplying their own table, chairs, tent, signage, tent weights, etc. Evelyn’s Park has a limited number of tent weights to share should there be a special need but vendors must be prepared with weights to secure their tents, stands and belongings. 
Vendor sales – Evelyn’s Park does not have WiFi so if you are using electronic payment methods, you will need to do so through your phone, tablet, or hotspot.
Trash and Recycling – Evelyn’s Park has large trash and recycling receptacles.  As a natural, sustainable green space, we encourage the use of recyclable containers, plasticware and cups.  We ask that as you load and unload, you recycle any/all items possible.  
Vendor Breakdown – All vendors must have their belongings packed up and will need to exit the park NO LATER THAN 3:00PM. Nothing can be left in the park.

No cooking of foods is allowed.

No music is allowed.

No dogs are allowed.  This is a City of Bellaire ordinance for all Bellaire parks.

HOLD HARMLESS AND INDEMNITY AGREEMENT
I, the undersigned vendor, binding my heirs, executors, administrators, estate and assigns, do hereby agree to completely and wholly release, indemnify and hold harmless Evelyn’s Park Conservancy for any and all claims, damages, harm, personal injury, including death, property damage, lawsuits and judgments, including court costs, expenses and reasonable attorney's fees, and all other expenses resulting from the activities, programs, and events occurring at and during the Market in the Park at Evelyn’s Park in Bellaire, Texas. It is the understanding of all parties that this release, indemnity, and hold harmless agreement shall apply whether or not the claims, damages, harm, personal injury, including deaths, property damage, lawsuits, judgments, court costs, attorney's fees or any other expense arise from the negligence of whatever nature, omissions, willful or intentional acts of the vendors or vendor's officers, agents, employees, independent contractors, other representatives, invites, licensees, or guests. If this vendor is other than an individual, vendor certifies, warrants and represents that the individual whose signature appears below is duly authorized to execute this Agreement on behalf of the firm, corporation, partnership or other entity who is the vendor.
